Litigation

This is MJW Attorneys Incorporated. We are a boutique law firm offering legal services in family law and civil litigation in the Overberg, but our virtual reach allows us to assist clients in most places.

Although we are a law firm, we do things a bit differently because we are a mediation referral firm.

What does this mean?

When appropriate, we refer our matters to our accredited mediator for virtual mediation. Our clients pay a fixed fee and participate in four 90-minute virtual mediation sessions. We don’t get involved in mediation, but we offer legal advice and support along the way.

LITIGATION AND COSTS

Your Attorney is charging you for their service and it’s not just a once-off fee.
We’re a small firm and so “big law” fees don’t work for us and for our clients – and we are okay to admit this! Our fixed fees are disclosed upfront and do not change.
The service we offer leaves our clients feeling satisfied that their money was well spent because we create the value that justifies the costs.

2. It does not identify and classify issues in dispute.

Our Mediator facilitates an agreement and we independently advise and finalise. This separation makes for a cleaner professional record.
A mediator’s duty is to both parties equally. They must remain neutral and cannot give either spouse or parent advice about what outcome is in their best interests only. An Attorney is mandated to represent their client and to act in their best interests.
